Terms of Service

These Terms govern your use of the Nuclear Pulse website, newsletter and the Nuclear Pulse Terminal (together, the “Service”). By creating an account, subscribing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The free Nuclear Pulse site and newsletter cover the nuclear energy sector. The Nuclear Pulse Terminal (“PRO”) is a paid subscription that provides additional data, tools, alerts and email briefings. We may add, change or remove features at any time.

2. Accounts

You sign in with a one-time code sent to your email address. You are responsible for keeping access to that email account secure and for all activity under your account. Subscriptions are for one individual; you may not share your account or access.

3. Subscriptions, trials and billing

• PRO is billed in advance on a monthly or annual basis through our payment processor, Stripe, at the price shown at checkout (plus any applicable taxes).
• Free trial. Eligible first-time subscribers receive a 7-day free trial. A payment method is required to start the trial. Unless you cancel before the trial ends, your subscription will begin and your payment method will be charged automatically at the end of the trial. One trial per customer.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. We will give you notice before any price increase takes effect for your subscription.
• Cancellation. You can cancel at any time from the billing portal in your account. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds are described in our Refund Policy.

4. Data and third-party sources

The Service aggregates information from third-party sources, including market data providers, the U.S. SEC, the U.S. NRC, news publishers and prediction-market venues. Data may be delayed, incomplete or inaccurate, and sources may become unavailable. Estimates (for example, projected earnings dates) are labelled as estimates. We do not guarantee the accuracy, completeness or timeliness of any data and you should verify information independently before acting on it.

5. Acceptable use

You may use the Service for your own personal or internal business purposes. You may not:

• copy, resell, redistribute, sublicense or publicly display data or content from the Terminal, except brief excerpts with attribution;
• scrape, crawl or use automated means to access the Service, or attempt to bypass access controls or rate limits;
• use the Service in violation of any law, including securities laws; or
• interfere with or disrupt the Service or its infrastructure.

6. Intellectual property

The Service, including its design, software, text and compilations of data, is owned by Nuclear Pulse or its licensors and is protected by law. Third-party content and trademarks remain the property of their owners. These Terms grant you a limited, revocable, non-transferable licence to use the Service as described here.

7. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, Nuclear Pulse will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading or investment losses, lost profits or lost data, arising from your use of or reliance on the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

9. Suspension and termination

We may suspend or terminate your access if you breach these Terms or if required by law. You may stop using the Service and cancel your subscription at any time.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify subscribers by email or in the Service before they take effect. Continued use after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
